What is a DUI?
Driving under the influence "means driving a vehicle when a person has consumed alcohol or one or more drugs, affecting the person to a degree that the person is substantially incapable, either mentally or physically or both, to exercise clear judgment, sufficient physical control or due care in the safe operation of a vehicle.

What is a DWAI?
Driving while ability impaired "means driving a vehicle when a person has consumed alcohol or one or more drugs, affecting the person to the slightest degree so that the person is less able then the person ordinarily would have been, either mentally or physically, or both, to exercise clear judgment, sufficient physical control or due care in the safe operation of a vehicle.

The legal BAC to operate a vehicle in the State of Colorado is .049 and below. This means that it only requires 2 drinks of alcohol for a person weighing 130 pounds to receive a DWAI if driving. The legal BAC for a person under the age of 21 is .019 and below. 

  • Alcohol in the body is measured through the Blood Alcohol Concentration (BAC).
  • Alcohol is a sedative-hypnotic drug/depressant. It is a system suppressor.
  • Persons convicted of a DUI or DWAI may have to complete community service and pay fines and court costs.

  • In Colorado, in 2001 there were 328 alcohol-related traffic deaths; each fatality cost 3.6 million dollars; and the cost for all DWI behavior in Colorado was 1.8 billion dollars. 
  • Drunk driving is the nation's most frequently committed violent crime.
  • The leading cause of death for 16-24 years old Americans is drunk driving.
  • Research shows that the first-time DWI offender drove up to 1,000 times while legally impaired without getting caught; and for offenders with two or more DWI offenses, up to 2000 times. 
  • Adult Americans consume up to three gallons of absolute alcohol each year per capita. 
  • Almost half of Americans aged 12 or older reported being current drinkers of alcohol in the 2001 survey (48.3%). This translates to an estimated 109 million people.
